Terms of Service

By accessing or using any service provided by Tricknowtech Web Solution ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our services.

These Terms constitute a binding legal agreement between you and Tricknowtech Web Solution and govern your use of our website, customer portal, and all services including web hosting, VPS, domain registration, DNS management, and value-added services.

You must be at least 18 years of age to use our services. By registering, you represent that:

You are at least 18 years old.

You have the legal capacity to enter into a binding agreement.

The information you provide is accurate and complete.

You are using our services for lawful purposes only.

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

Provide accurate, current, and complete information during registration.

Notify us immediately of any unauthorised access to your account.

Not share your login credentials with third parties.

Accept responsibility for all activities that occur under your account.

Tricknowtech Web Solution cannot be held liable for losses resulting from unauthorised access to your account due to your failure to keep credentials secure.

We commit to a 99.9% monthly uptime SLA for hosting and VPS services. This equates to no more than approximately 43.8 minutes of unplanned downtime per month.

Uptime calculations exclude:

Scheduled maintenance windows (minimum 48 hours notice).

Downtime caused by customer actions (e.g., misconfiguration, resource abuse).

Force majeure events (natural disasters, government actions, DDoS attacks beyond our mitigation capacity).

Third-party service failures outside our control.

Service credits for SLA breaches are limited to a proportional credit of the affected month's fees.

You agree not to use our services for any of the following purposes:

Hosting or distributing illegal content, including child sexual abuse material (CSAM), pirated software, or copyrighted material without authorisation.

Sending unsolicited bulk email (spam) or operating an open mail relay.

Conducting port scans, network intrusion, or any form of denial-of-service (DoS/DDoS) attacks.

Mining cryptocurrency on shared hosting resources.

Running IRC bots, torrent trackers, or peer-to-peer file sharing without prior approval.

Hosting phishing pages, malware, or exploiting security vulnerabilities.

Any activity that violates applicable Indian law or international law.

Violation of the Acceptable Use Policy may result in immediate service suspension without refund.

All payments are processed in Indian Rupees (INR). Prices shown are final — no additional taxes will be added at checkout.

Due Date: Invoices are due on the date specified. Services may be suspended if payment is not received within 7 days of the due date.

Auto-Renewal: Unless cancelled before the renewal date, subscriptions will automatically renew for the same period.

Payment Methods: We accept UPI, net banking, credit/debit cards, and wallet payments via Cashfree.

Invoice: A payment invoice will be issued for all purchases and emailed to your registered address.

By You: You may cancel your services at any time from the customer portal. Cancellation takes effect at the end of the current billing period unless you request immediate termination.

By Us: We reserve the right to suspend or terminate services immediately and without notice if:

You violate the Acceptable Use Policy.

A chargeback or payment dispute is initiated.

Your account is found to be engaged in fraudulent activity.

Upon termination, you are responsible for backing up all data. We are not liable for data loss following termination.

While we perform daily automated backups as part of our platform, these are provided as a convenience and are not guaranteed. You are solely responsible for maintaining independent backups of all your data.

Tricknowtech Web Solution is not liable for data loss under any circumstances. We strongly recommend maintaining at least two independent copies of critical data stored in separate geographic locations.

All content on our website, including text, graphics, logos, and software, is the property of Tricknowtech Web Solution or its licensors and is protected by Indian copyright law. You may not reproduce, distribute, or create derivative works without our written consent.

We do not claim ownership over content you upload or host on our infrastructure.

To the maximum extent permitted by applicable law:

Tricknowtech Web Solution shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity.

Our total aggregate liability for any claim arising from these Terms shall not exceed the amount paid by you for the affected service in the preceding 3 months.

We are not liable for third-party acts, including upstream network failures, domain registry issues, or payment processor outages.

You agree to indemnify, defend, and hold harmless Tricknowtech Web Solution and its employees from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of our services, your content, or your violation of these Terms.

Any disputes arising out of or in connection with these Terms shall be resolved as follows:

1. Informal Resolution: Contact us at [email protected]. We will attempt to resolve the dispute within 30 days.

2. Mediation: If informal resolution fails, the parties agree to attempt mediation before initiating legal proceedings.

3. Jurisdiction: These Terms are governed by the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of courts in Thane, Maharashtra.

We may modify these Terms at any time. Changes will be posted on this page with an updated effective date. For material changes, we will notify registered customers via email at least 14 days before the changes take effect. Continued use of our services after the effective date constitutes acceptance of the updated Terms.
